List of Common Criminal Offenses

Indictable Offenses


These are heard in the Superior Court.
Can be filed in Municipal Court but are transferred to the Superior Court.

Will be reviewed by the Middlesex County Prosecutor's Office. Upon review, the County Prosecutor may choose to downgrade the offense to a disorderly offense and send the case back to the Municipal Court.

2C:12-1B - aggravated assault
2C:12-3 - terrorist threats
2C:14-2 - sexual assault
2C:15-1 - robbery
2C:17-3 - criminal mischief, property damage $500 or more
2C:18-2 - burglary
2C:20-3 - theft $200 or more
2C:20-4 - theft by deception $200 or more
2C:20-11 - shoplifting $200 or more
2C:21-5 - bad check $200 or more
2C:21-6 - credit card theft
2C:29-2 - resisting arrest using physical force
2C:35-10a(1) - possession of controlled dangerous substance
2C:35-10a(3) - possession of over 50 grams of marijuana
2C:39-5 - possession of a weapon

Disorderly Offenses


These are heard in Municipal Court.
Less serious than indictable offenses.

2C:12-1a - simple assault
2C:14-4 - lewdness
2C:17-3 - criminal mischief, property damage $499 or less
2C:18-3b - trespassing
2C:20-3 - theft $199 or less
2C:20-4 - theft by deception $199 or less
2C:20-11 - shoplifting $199 or less
2C:21-5 - bad check $199 or less
2C:29-2 - resisting arrest
2C:33-2 - disorderly conduct
2C:33-4 - harassment
2C:35-10a(4) - possession of under 50 grams of marijuana
2C:35-10b - under the influence or use of a controlled dangerous substance
2C:35-10c - failure to make lawful disposition of controlled dangerous substance
2C:36-2 - possession of drug paraphernalia
